Terms of Service

These Terms are a binding agreement between you and Partial Platforms Inc. ("Partial", "we", "us") for your use of the Partial app and related services (the "Service").

You accept these Terms and our Privacy Policy by tapping Create an account on the first screen of the app. If you do not agree, do not use the Service.

1. The Service

Partial is a dating app for adults. You can create a profile, post and vote on opinions, match and message with other members, connect with friends through invite codes, join group and opinion chats, and ask friends to act as your wingman.

Partial is free and paid for by advertising. There are no purchases or subscriptions.

Partial has its own account, which sends you a welcome message.

2. Eligibility and account setup

You may use Partial only if:

• you are 18 or older;
• you are in Canada;
• you use a genuine device running the app as we published it; and
• you have not been removed from the Service before.

We remove accounts belonging to anyone under 18 when we become aware of them.

Before your account is created, we ask your date of birth and check that your device is genuine. We may refuse sign-up. The app does not show the reason; section 3 of our Privacy Policy explains how to ask about it. Giving a false date of birth breaks these Terms.

Before you can use the Service, you must complete the identity check, a video selfie that records your face (see our Privacy Policy). You then choose the full app or Wingman only, a version of the Service with no dating profile, and complete:

• for the full app, your display name, at least three photos the check has found you in, your gender identity and who you are interested in, and your home location;
• for Wingman only, your display name and one profile picture.

Until then, your account can only sign in, manage its sign-in methods and delete itself. We may also hold an account for review by a person, for example if the identity check suggests its owner may be under 18.

• One face, one account. An account whose face is already enrolled on another account is refused.
• Defeating or cheating the identity check (for example with a photo, mask or someone else's face) breaks these Terms.
• If you believe a sign-up or setup decision is wrong, write to admin@partial.chat.

3. Your account

• You are responsible for activity on your account and for keeping your sign-in methods secure.
• One account per person. Do not share your account or create one for someone else.
• Your profile must be truthful. A photo that shows people must include you.
• If your account has only a passkey, you must keep access to a device holding it. We cannot recover the account if you lose access to every device holding it.
• Tell us promptly if you believe someone else has accessed your account.
• Your home location and the centre of your search area can each be changed twice every 30 days. Other members see your city, and your neighbourhood only if you choose to show it — never your address.
• Friend invite codes are for giving to people you know. You are responsible for requests that result from a code you make public.
• Group chats: a friend can add you to a group without asking. You can leave at any time. Only the person who created a group can remove members.
• Wingmen: what you see as someone's wingman is for that friend only. Do not copy it or use it to contact, expose or harass anyone.

4. Community rules

We have zero tolerance for objectionable content and abusive behaviour. Content that breaks these rules is removed, and the member responsible may be suspended or permanently removed without warning.

You must not post, send or share:

• anything sexualising or endangering a minor, or any attempt to contact a minor (we report this to the authorities);
• nudity or sexually explicit content;
• harassment, bullying, threats, or unwanted contact after someone has stopped replying or blocked you;
• hate speech attacking people for their race, ethnicity, national origin, religion, disability, sex, gender identity or expression, sexual orientation or age;
• violence, or content glorifying it;
• content promoting self-harm or suicide;
• impersonation, including photos that are not of you;
• scams, fraud or solicitation, including requests for money or financial details, advertising, and commercial sexual services;
• other people's personal information, private messages or photos without their consent;
• illegal content, or content infringing someone else's rights.

You must not use bots or automated access, scrape member data, evade a block, suspension or removal (including by creating a new account), or interfere with the Service.

5. Reporting and blocking

Every profile, chat, photo and opinion has a Report option. The person you report is not told.

You can block any member. Blocking works in both directions: neither of you can contact the other or see the other's profile. Partial's own account cannot be blocked, but it can be reported. Blocking someone does not remove them from a group chat you share; you can leave the group.

You can also unmatch someone, remove a friend, and archive or delete a conversation.

6. Moderation

We review reports and aim to act on them within 24 hours. Content reported for involving a minor, self-harm or a threat of violence is usually hidden while a person reviews it.

We screen photos and text automatically. Content may be refused, or published and referred to a person. Automated screening is not perfect.

If you break these Terms, we may remove content, limit features, or suspend or permanently remove your account. Serious breaches lead to permanent removal. If you think we made a mistake, write to admin@partial.chat.

7. Safety when meeting members

You are responsible for your interactions with other members, online and in person.

• We do not conduct criminal background checks or check members against any registry.
• The identity check is not a safety check. It confirms only that a member is a real person whose photos show them. We do not verify anyone's name, age, background or intentions.
• Meet in public, arrange your own transport, tell someone where you are going, and never send money, cryptocurrency, gift cards or financial details to another member.
• If you are in immediate danger, contact emergency services.

8. Your content

You keep ownership of the content you post ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for display, and distribute Your Content to operate, secure and improve the Service, for as long as we hold it under our Privacy Policy. We do not use Your Content in ads.

You confirm that you have the rights to Your Content and that it does not break section 4.

Copyright. If you believe something on Partial infringes your copyright, write to admin@partial.chat with what the Copyright Act asks for: your name and address, the work, your right in it, where the content appears in Partial, and the infringement you are claiming. As that Act requires, we forward your notice to the member who posted the content and tell you we have done so. We do not forward demands for payment or settlement. Content that infringes someone else's rights breaks section 4, and we may remove it.

When you delete your account, opinions you posted and messages you sent remain, no longer linked to your name, email address or phone number (see our Privacy Policy).

9. Our content

The app, its name, logo, design and software belong to us or our licensors. You may use them only to use the Service.

10. Privacy

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

11. Suspension, termination and deletion

We may suspend or remove your access, with or without notice, if you break these Terms, if the law requires it, or to protect members or the Service. If your account is removed, you must not create another one. We may stop offering the Service, or part of it, on reasonable notice.

You can deactivate your account (Settings → Deactivate my account), which switches it to Wingman only, or delete it at any time (Settings → Delete my account, or date.partial.chat/docs/delete-account). Deletion is immediate and permanent.

12. Disclaimers

If you are a consumer resident in Quebec, this section does not apply to you to the extent that the Consumer Protection Act (Quebec) or the Civil Code of Québec does not permit it.

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, and we do not promise that the Service will be uninterrupted or error-free, that content is accurate, or that you will find a match.

13. Limitation of liability

If you are a consumer resident in Quebec, this section does not apply to you to the extent that the Consumer Protection Act (Quebec) or the Civil Code of Québec does not permit it.

To the extent permitted by law:

• we are not liable for indirect, consequential or punitive damages, or for loss of data or profits, arising from your use of the Service, including your dealings with other members;
• you release us from claims arising from your interactions with other members; and
• our total liability is limited to the amount you have paid us for the Service, which is nil.

Nothing in these Terms limits liability for bodily or moral injury, or for intentional or gross fault, where the law does not allow it, or limits any other right you have under consumer protection laws.

14. Indemnity

If you are a consumer resident in Quebec, this section does not apply to you to the extent that the Consumer Protection Act (Quebec) or the Civil Code of Québec does not permit it.

To the extent permitted by law, you agree to indemnify us against claims and reasonable legal costs arising from your breach of these Terms or from Your Content.

15. Governing law

If you live in a province other than Ontario, including Quebec, you keep the protection of that province's consumer protection laws and may bring proceedings in its courts. The rest of this section does not apply to you to the extent those laws do not permit it.

These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction.

16. Changes to these Terms

We may change sections 2 to 18 of these Terms. We will not change the nature of the Service described in section 1, or charge for it, without your agreement.

We will notify you in the app or by email at least 30 days before a change takes effect. The notice will set out the new wording, the wording it replaces, the date it takes effect and your right to refuse the change. If you do not accept the change, you may delete your account at no cost, before the change takes effect or up to 30 days after.

17. App store terms

Apple. If you downloaded Partial from the App Store, Apple's standard Licensed Application End User License Agreement also applies. Where it conflicts with these Terms on a matter it covers, Apple's agreement applies.

Google. If you downloaded Partial from Google Play, the Google Play Terms of Service also apply. Google is not a party to these Terms.
